1. Trade Sale Terms 

This vehicle is being sold strictly under Trade Sale / Dutch Auction Terms. 

By signing this document, the purchaser confirms that they understand and accept the 

following conditions: 

1. The vehicle is sold as seen, tried, and approved by the buyer, without any implied 

warranties as to condition, fitness for purpose, or merchantable quality under the 

Consumer Rights Act 2015. 

2. Vehicles under the Dutch Auction scheme are priced below retail value to reflect their 

age, mileage, cosmetic condition, or required maintenance. 

3. The buyer acknowledges that no returns, refunds, or post-sale claims will be 

accepted once the vehicle has been removed from the premises. 

4. The vehicle may have mechanical, electrical, or cosmetic faults, and the purchaser 

accepts full responsibility for any repairs after the point of sale. 

5. The auction principle applies — prices are reduced daily or periodically until sold. 

The buyer’s oAer at the current listed price constitutes full acceptance of the Dutch 

Auction terms. 

6. All vehicles sold under this scheme come with Kirkham Part Exchange Centre’s 

Standard 12-Month Parts & Labour Warranty, unless expressly excluded in writing. 

7. A non-refundable £199 Dutch Auction fee is applicable and included in the agreed 

sale price to cover administrative, valeting, and documentation costs. 

8. The vehicle may be sold as unroadworthy or requiring MOT repair work, and it is the 

buyer’s responsibility to ensure the vehicle meets road-legal standards before use on 

public highways. 

9. The purchaser acknowledges that they have been given every opportunity to inspect and 

test the vehicle and are satisfied with its condition prior to purchase. 

10. The buyer understands that no reasonable oAer will be rejected, but unreasonable or 

“silly” oAers will be returned with equally silly answers – this is a fair-trade, 

transparent auction environment. 

2. Dealer Declaration 

We, Kirkham Part Exchange Centre Ltd, confirm that the above vehicle has been sold at a 

discounted Dutch Auction trade price, under trade sale terms, and that the purchaser has had 

the opportunity to inspect and test drive the vehicle prior to completion of sale.
